Searching Cases by Name
Circuit and Family searches in Upshur County run through the WVPASS Name tab. The form is dynamic, so option lists appear only after the application finishes loading. Expect a party-name control plus filters for county, case type, year, filing-date range, case status, and security level. Choose Upshur County. Then apply only the filters that fit facts you already know.
Magistrate Court works differently. Enter through MCRSearch. Accept the disclaimer gate. Then search by first name and last name or by case number. The free search needs no registration, and the Judiciary says it returns no more than 30 records. Before opening a result, compare filing date, charge, disposition, and case context. That way the record matches the person you mean.
- Identify Circuit, Family, or Magistrate Court from the notice or type of case.
- Open WVPASS for Circuit or Family, or MCRSearch for Magistrate.
- Enter the name as it appears in the record and select Upshur County when that control is available.
- Narrow WVPASS results by year, type, dates, or status only when those details are known.
- Open the matching case and compare its number, filing date, court, and party role.

Upshur County Case Search Portals
The Judiciary Court Record Access gateway offers two distinct doors. WVPASS covers public Circuit Court information statewide and doubles as the practical route for Upshur County Family cases. MCRSearch handles Magistrate case information statewide. One Judiciary website, two separate databases.
Buckhannon Municipal Court sits outside both portals for city ordinance cases. The city posts no public docket search online, so call City Hall at 304-472-1651 and ask for the municipal court or the recorder. Federal cases tied to Upshur County run through PACER or CM/ECF, usually under the Northern District's Elkins assignment.
Searching by Case Number
An exact case number beats a common name every time. WVPASS offers a Case route built around the number itself. Runtime filters cover county, case type, year, date, status, and security. The static page publishes no official Upshur input mask. So copy the number exactly as the clerk, a court notice, or a filed document supplies it. Never guess a county prefix.
Magistrate payment materials show formats like ##-M##X-##### and M##M-##########. Treat those as payment lookup examples, not a full glossary for Upshur County cases. MCRSearch accepts a case number in place of first and last name. A citation ID or payment plan ID, though, belongs in the fine-payment system. It does not belong in the general case register.
Upshur County Case Search Filters
WVPASS is a dynamic application, and that has consequences. A simple fetch can stall at "WVPASS is loading" or throw an application error. Such a failure says nothing about the Upshur County case itself. The case may be alive and well at the courthouse. Retry in a current browser session. Then fall back to the clerk if the form still refuses to render.
Three routes serve three needs. The Name route covers parties. The Case route covers a known case number. The Attorney route covers a name or bar ID. Each may offer county, case type, year, filing dates, status, and security filters. The option lists load at runtime. So search broadly first and review results carefully rather than inventing a category the form never offered.
What a Case Search Returns
A public result identifies the case; the detail view holds the register behind it. MCRSearch lays out header, charge, party, event, docket-entry, bond, judgment, and disposition blocks. WVPASS can supply public Circuit case information, docket events, and qualifying document links.
| Case identity | Case number, location, description or style, and filing date. |
|---|---|
| Case type | The court category and trial type when the system exposes them. |
| Party roles | Names and roles that help distinguish similar results. |
| Event schedule | Hearing, date and time, courtroom, and location where populated. |
| Docket entries | Chronological records with filing date, code, description, and filer where shown. |
| Outcome fields | Charge, plea, judgment, sentence, or disposition information as applicable. |
A list of documents is one thing; document images are another. MCRSearch publishes no Magistrate court documents online. WVPASS opens eligible public Circuit documents after registration, at 25 cents per page plus a nominal card-processing fee. A downloaded image still is not a certified copy.
Upshur County Case Search Limit
MCRSearch greets every visitor with a terms and disclaimer screen. Check "Click to continue," select Submit, and the search appears. The official disclaimer warns that online data may be inaccurate or incomplete. It points users to the clerk for validation. This is a gateway step, not registration.
The official Magistrate access page caps results at 30. A common name may therefore demand better spelling, a case number, or clerk help. The Upshur County Magistrate Clerk is Geneva Peggs. Her office sits at 38 West Main Street, Room 204, Buckhannon, phone 304-472-2053. That office supplies documents and supports the local public terminal.
Upshur County Case Search Gate
The official continuation screen shows the required gate before an Upshur County Magistrate search.

The sequence is straightforward: accept the public-use notice, proceed to the form, and verify any critical Upshur County result with the clerk. Each step guards the record's integrity.
Statewide vs County Case Search
Upshur County has no county-branded case-search database of its own. The real choice is between statewide online systems and the local offices that keep the originals. Statewide portals serve as the search layer. County clerks hold the actual court records and supply copies or confirmation.
| Channel | Coverage | Best use |
|---|---|---|
| WVPASS | Public Circuit information statewide; Upshur Circuit and practical Family route | Name, number, attorney, docket, event, and eligible document lookup |
| MCRSearch | Magistrate case information statewide | Free name or number search, limited to 30 results |
| Circuit Clerk | Upshur Circuit and Family original records | Portal failure, older file, copy, certification, or access question |
| Magistrate Clerk | Upshur Magistrate records | Document copies, public terminal, and validation |
WVPASS is not the E-File system. West Virginia's Circuit and Family Court E-File platform serves registered filers and delivers service copies, so it is not a public docket search for everyday users. Upshur County joined that filing environment in 2022. Even so, public case lookup still runs through WVPASS and the Circuit Clerk.
That rollout left Upshur County with three separate technology dates. Circuit and Family E-File went live locally on November 7, 2022. The free statewide Magistrate search followed on January 25, 2024. WVPASS public Circuit searching launched on March 10, 2025. Each milestone added a different function. None merged Magistrate records into WVPASS, turned E-File into a public tool, or built a county-only portal. Pick your system by court, not by release date.
Missing Upshur County Case Search Results
A blank result can mean several things. The wrong court may have been searched. A Magistrate preliminary matter may later carry a Circuit case number. Names get misspelled. The file may predate online coverage, or it may sit on another storage medium. It could also be restricted by law or court order.
Transfers are where a two-system search pays off. Magistrate Court handles preliminary examinations on felony warrants. The prosecution after indictment, information, or transfer lives on the Circuit docket. The original Magistrate register may show an order or event. The later Circuit matter may carry a new number. So search MCRSearch first when the known record began before a magistrate. Then search WVPASS for the Circuit stage. A transfer entry is not the final disposition of the prosecution.
For Circuit and Family cases, call Brian P. Gaudet, Upshur County Circuit Clerk, at 304-472-2370 or visit 38 West Main Street. For Magistrate matters, call 304-472-2053 or use the public terminal in Room 204. A mailed request should give the exact case number if known. Include the court, the parties, the record sought, the date range, the copy type, and contact information. The clerk's office takes these requests by phone, mail, or visit. No email or copy-request form is offered.
Access and Restricted Cases
WVPASS excludes sealed filings and juvenile cases. Family Court orders and indices may be public. Family pleadings, exhibits, recordings, and proceedings get broader confidentiality protection. MCRSearch cannot override a court restriction either. So an empty result can reflect limited access. It may not mean the absence of an Upshur County proceeding.
West Virginia Trial Court Rule 10 keeps court records generally accessible. But it permits restriction by law or court order. Rule 10.03 requires an order to state the nature, duration, and reasons for a restriction. Juvenile confidentiality also rests on state law and court rules. Anyone seeking authorized access should contact the office holding the record. Identify the case, and provide any order or status the court requires. Searching repeatedly will never reveal a sealed record.
Expunged material follows the court's order and governing law. Public portals are not the place to request unsealing or expungement relief. For a broader look at a setting tied to a found case, use the Upshur County court calendar routes. Then verify the live date with the responsible office.
